1. Agreement and operator
ESA Motion is operated by Esacode, LLC. By creating an account, accessing an ESA Motion product, purchasing a subscription, or otherwise using the service, you agree to these Terms where acceptance is required.
2. Accounts
You must provide accurate information, keep your credentials confidential, and promptly address unauthorized access to your account. You are responsible for activity performed through your account. You may not share credentials in a way that circumvents seat, subscription, license, or product restrictions.
3. Product licenses
ESA Motion may offer Free, Pro, Enterprise, trial, or other tiers. Unless expressly stated otherwise, product access is a limited, revocable, non-exclusive, non-transferable license. Features, usage limits, pricing, and availability may evolve over time.
4. FrameDesigner and engineering responsibility
FrameDesigner and other ESA Motion engineering tools are design aids. They do not provide professional engineering certification, regulatory approval, structural certification, vehicle homologation, or a guarantee that a design is safe, manufacturable, or fit for a particular purpose.
You are responsible for independently reviewing dimensions, materials, joints, loads, constraints, simulations, fabrication instructions, exported geometry, regulations, and the safety of any structure or vehicle built from the output. Safety-critical projects should be reviewed by appropriately qualified professionals.
5. Simulations and calculations
Simulation and calculation outputs are approximations based on the geometry, material properties, boundary conditions, loads, numerical assumptions, and other inputs supplied to the software. Results can be wrong if inputs are incomplete or if a model does not capture relevant real-world behavior. Always validate critical results independently.
6. Subscriptions and billing
Paid subscriptions are billed according to the price and interval shown at purchase. Unless otherwise stated, recurring subscriptions may renew automatically until canceled. Cancellation generally prevents the next renewal while preserving already-paid access through the current billing period, subject to the purchase terms and applicable law.
Payments may be processed by third parties such as Stripe. Taxes, refunds, credits, and prorations are handled according to the purchase flow, applicable law, and payment-provider rules.
7. Enterprise teams
Enterprise plans may include a specified number of seats. Organization owners or administrators are responsible for invitations, seat assignments, and authorized team membership. Seat sharing or other attempts to exceed purchased capacity are not permitted.
8. User projects and files
You retain ownership of project data and content you create, subject to rights already granted to others. You grant ESA Motion the limited rights necessary to operate, secure, troubleshoot, and provide requested services. When project data is stored only in your browser, device, or downloaded project file, ESA Motion may not possess a recoverable server copy. You are responsible for backups.
9. Public tutorials and blog articles
ESA Motion publishes educational content about engineering, design, software workflows, and fabrication. This information is provided for general educational purposes and may not address every material, safety, regulatory, or project-specific factor. Public tutorial and blog article pages may contain advertising.
10. Acceptable use
You may not:
- use ESA Motion unlawfully or to infringe third-party rights;
- attempt unauthorized access to accounts, private data, servers, APIs, protected modules, or infrastructure;
- circumvent authentication, licensing, subscription, seat, export, or feature controls;
- introduce malicious code or interfere with availability or security;
- automatically scrape protected service functionality in a way that violates these Terms or applicable law;
- misrepresent ESA Motion outputs as professional certification or approval;
- resell or sublicense access unless ESA Motion expressly authorizes it.
11. Intellectual property
ESA Motion software, branding, interface elements, documentation, site content, and proprietary service components are owned by or licensed to Esacode, LLC and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of ESA Motion intellectual property to you.
12. Third-party services
ESA Motion may integrate with or link to third-party services, libraries, payment providers, advertising providers, model repositories, or websites. Third-party services are governed by their own terms and policies.
13. Availability and changes
We may modify, update, suspend, discontinue, or replace functionality. We do not guarantee uninterrupted or error-free availability. Maintenance, security incidents, provider outages, browser changes, and other events may affect service availability.
14. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESA MOTION SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT SOFTWARE, CALCULATIONS, SIMULATIONS, EXPORTS, OR FABRICATION OUTPUTS WILL BE ERROR-FREE OR SUITABLE FOR A PARTICULAR PROJECT.
15. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESACODE, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS, USE, MATERIALS, OR FABRICATED PARTS ARISING FROM USE OF ESA MOTION. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
16. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles, except where applicable consumer law requires otherwise.
17. Changes
We may update these Terms as ESA Motion changes. Material changes may require renewed acceptance before further product access.
