1. Who we are
ESA Motion is operated by Esacode, LLC (“ESA Motion,” “we,” “us,” or “our”). This policy applies to esamotion.com, ESA Motion accounts, support services, public tutorials and resources, and ESA Motion products such as FrameDesigner.
2. Information we collect
Depending on how you use ESA Motion, we may collect:
- Account information: name, email address, account identifiers, password-verification status, authentication records, and team or organization membership.
- Subscription and billing metadata: plan, subscription status, seat assignments, invoice identifiers, payment status, and related records. Payment-card processing is handled by payment providers such as Stripe; ESA Motion does not need to store your full card number.
- Support communications: information you submit through our support form or other communications.
- Technical and security information: IP address, browser or user-agent information, timestamps, session information, error logs, and security events.
- Product usage information: events needed to operate, secure, diagnose, and improve ESA Motion products, such as feature usage, project actions, license checks, and performance information.
- Advertising information on eligible public content pages: advertising cookies, identifiers, approximate location derived from IP address, ad impressions, and interactions as described below.
3. How we use information
- create, authenticate, and protect user accounts;
- provide software, subscriptions, team seats, licensing, and support;
- process and reconcile payments and invoices;
- prevent abuse, fraud, spam, unauthorized access, and license circumvention;
- operate, troubleshoot, measure, and improve ESA Motion products and content;
- communicate account, billing, security, support, and service information;
- display and measure advertising on eligible public tutorial and blog article pages;
- comply with legal obligations and enforce applicable agreements.
4. Cookies and similar technologies
ESA Motion uses cookies and similar technologies for essential functions such as authentication, persistent login, security, session management, preferences, and service operation. These essential technologies may be used when needed to provide the service you request.
Public tutorial and blog article pages may also use advertising technologies as described in the Google AdSense section below. Where applicable law requires consent for non-essential cookies or similar identifiers, those technologies will be handled through the applicable consent mechanism.
5. Google AdSense and advertising cookies
ESA Motion may use Google AdSense to display advertising on eligible public content pages, such as tutorials and blog articles. Advertising is intentionally separated from account, billing, support, and product-workspace pages.
Third-party vendors, including Google, may use cookies to serve ads based on a user's prior visits to ESA Motion or other websites. Google's use of advertising cookies enables Google and its partners to serve ads based on visits to ESA Motion and/or other sites on the Internet.
Users can manage or opt out of personalized advertising through Google Ads Settings. You can learn how Google uses information from sites and apps that use its services at How Google uses information from sites or apps that use our services.
Other advertising vendors or networks may also use cookies, web beacons, IP addresses, or similar technologies when they are enabled on ESA Motion. Their use of information is governed by their own privacy policies and applicable user choices.
Newsletter and marketing communications
ESA Motion sends promotional or educational newsletters only to users who affirmatively opt in. Newsletter consent is optional and is not required to create or use an account. Users can change the preference from their dashboard or use the unsubscribe link included in each marketing email. Unsubscribing from marketing does not prevent transactional messages needed for account security, billing, verification, support, or service operation.
6. Personalized and non-personalized advertising
Depending on location, consent choices, and advertising settings, ads may be personalized or non-personalized. Personalized ads can use information about prior activity or interests. Non-personalized ads use contextual information and may still use cookies or identifiers for functions such as frequency capping, fraud prevention, and aggregated reporting.
Where legally required, ESA Motion will use a consent-management mechanism for advertising choices before requesting consent-dependent advertising processing.
7. U.S. state privacy choices
ESA Motion does not sell personal information for monetary consideration. Certain advertising or cross-context behavioral advertising activities can be considered “sharing,” “targeted advertising,” or similar concepts under some U.S. state privacy laws. Where applicable, users will be provided the privacy choices required by those laws.
8. Service providers and disclosures
We may disclose information to service providers that help us operate ESA Motion, including hosting, email delivery, payment processing, security, analytics, support, and advertising providers. We may also disclose information when required by law, to protect users or the service, to investigate abuse, or in connection with a merger, financing, acquisition, or sale of business assets.
9. Legal bases where applicable
Where data-protection law requires a legal basis, ESA Motion may process information because it is necessary to provide a requested service or contract, because we have a legitimate interest in operating and securing the service, because we must comply with a legal obligation, or because you provided consent for processing that requires consent. Consent may be withdrawn where applicable.
10. Data retention
We retain information for as long as reasonably necessary for account operation, subscriptions, support, security, legal compliance, tax and accounting requirements, dispute resolution, fraud prevention, and legitimate business purposes. Retention periods vary by type of information.
11. Security
We use reasonable administrative and technical safeguards intended to protect information. No Internet service, network, or storage system can guarantee absolute security.
12. Your privacy rights
Depending on where you live, you may have rights to request access, correction, deletion, portability, restriction, or objection regarding personal information, and to make choices about certain advertising uses. To submit a privacy request, use the ESA Motion Support form and identify the request as a privacy request.
13. Children
ESA Motion services are not directed to children under 13. If a higher age threshold applies under local law, the applicable threshold governs.
14. International processing
ESA Motion and its service providers may process information in the United States and other countries. Where required, appropriate legal mechanisms are used for international transfers.
15. Changes to this policy
We may update this Privacy Policy as ESA Motion, our products, advertising providers, or applicable requirements change. The effective date at the top of this page will be updated when a revised policy is published.
