Terms of Service & Privacy Policy

1. Who we are
ESA Motion is operated by Esacode, LLC (“ESA Motion,” “we,” “us,” or “our”). These Terms govern your use of ESA Motion services. This Privacy Policy explains how information is collected, used, shared, and protected when you use those services.
2. Account requirements
You must provide accurate account information and keep your credentials confidential. You are responsible for activity performed through your account. You may not share credentials in a manner that circumvents applicable seat, subscription, or product restrictions.
You must be legally capable of entering into these Terms. ESA Motion services are not directed to children under 13.
3. Products and licenses
ESA Motion may offer Free, Pro, Enterprise, trial, or other product tiers. Features, limits, pricing, and availability may change over time. Paid rights remain subject to the applicable subscription status, billing period, and seat assignment.
Unless expressly stated otherwise, access is a limited, revocable, non-exclusive, non-transferable license to use the service. You may not bypass authentication, subscription enforcement, product limits, seat restrictions, or technical controls; copy protected application components to recreate subscription-only functionality; or use the service to violate law or third-party rights.
4. FrameDesigner and engineering responsibility
FrameDesigner is an engineering/design aid. It does not provide professional engineering certification, vehicle approval, structural certification, safety approval, or a guarantee that a design is fit for fabrication or operation.
You are responsible for reviewing dimensions, materials, joints, loads, fabrication instructions, exported geometry, regulatory requirements, and the safety of any structure or vehicle designed or manufactured using the software. Critical designs should be independently reviewed by appropriately qualified professionals.
5. Free-plan advertising
The Free version of FrameDesigner may display advertising. Advertisements may be supplied by ESA Motion or third-party advertising providers. Advertising technology may process information such as device or browser identifiers, approximate location derived from IP address, ad interactions, and similar technical information as permitted by applicable law and applicable provider settings.
Where applicable law requires consent for non-essential advertising cookies, tracking, or personalized advertising, ESA Motion will use an appropriate consent mechanism before enabling that processing. Paid product tiers may use a different advertising model or may be advertisement-free, as described on the applicable plan page.
6. Subscriptions, billing and cancellation
Paid subscriptions are billed according to the price and billing interval shown at purchase. Payment processing is provided by third-party payment providers such as Stripe. ESA Motion does not need to receive or store your full payment-card number.
Unless otherwise stated at purchase, subscriptions may renew automatically until canceled. Cancellation generally stops future renewal while retaining access through the already-paid subscription period. Refunds, credits, taxes, and prorations are handled according to the purchase flow, applicable law, and payment-provider rules.
7. Acceptable use
- Do not use the service unlawfully or infringe intellectual-property rights.
- Do not attempt unauthorized access to accounts, servers, protected modules, APIs, or data.
- Do not circumvent licensing, advertising, subscription, seat, export, or feature controls.
- Do not introduce malware, abuse automated interfaces, or materially disrupt the service.
- Do not resell or sublicense ESA Motion access unless expressly authorized.
8. Your projects and content
You retain ownership of project data and content that you create and upload, subject to rights you already granted to others. You grant ESA Motion the limited rights reasonably necessary to operate, secure, troubleshoot, and provide the services you request.
Where project data is stored only in your browser or device, ESA Motion may not possess a server copy. You are responsible for maintaining appropriate backups of important project files and exports.
9. Information we collect
- account information such as name, email address, account ID, and authentication records;
- subscription, product, seat, invoice, and transaction metadata;
- support requests and communications;
- technical information such as IP address, browser/user-agent information, timestamps, security logs, and session information;
- product usage information needed to operate, secure, troubleshoot, and improve the service;
- advertising-related information for Free products where advertising is enabled.
10. How we use information
- create and authenticate accounts;
- provide products, licensing, subscriptions, team seats, and support;
- process and reconcile payments;
- prevent fraud, abuse, piracy, spam, and security incidents;
- maintain, diagnose, and improve ESA Motion products;
- communicate service, account, billing, and support information;
- display and measure advertising in Free products where applicable;
- comply with legal obligations and enforce agreements.
11. Cookies and similar technologies
ESA Motion uses cookies or similar technologies for authentication, persistent login, security, preferences, and other service functions. Advertising or analytics providers may use additional technologies when enabled. Where required, non-essential technologies will be subject to applicable consent choices.
12. How information may be shared
We may share information with service providers that help operate ESA Motion, such as hosting, payment processing, email delivery, security, support, analytics, and advertising providers. We may also disclose information when required by law, to protect rights or security, or in connection with a corporate transaction.
13. Data retention and security
We retain information for as long as reasonably necessary for account, subscription, support, security, legal, tax, dispute-resolution, and service purposes. Retention periods may vary by data type.
We use reasonable administrative and technical safeguards, but no online service or storage system can guarantee absolute security.
14. Your privacy choices and requests
Depending on where you live, you may have legal rights concerning access, correction, deletion, portability, restriction, objection, or certain uses of personal information. You may contact ESA Motion through the Support page to make a privacy request.
15. Third-party services and links
ESA Motion may interoperate with or link to third-party services, libraries, payment processors, advertising providers, model repositories, or other websites. Their services and privacy practices are governed by their own terms and policies.
16. Intellectual property
ESA Motion software, branding, site content, proprietary algorithms, interface elements, and protected service components are owned by or licensed to Esacode, LLC and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
17. Service availability and changes
We may modify, update, suspend, discontinue, or replace service functionality. We do not guarantee uninterrupted or error-free operation. We may take reasonable actions to protect the service, users, or infrastructure.
18. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESA MOTION SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT ENGINEERING OUTPUTS WILL BE ERROR-FREE OR SUITABLE FOR A PARTICULAR STRUCTURE, VEHICLE, OR FABRICATION PROCESS.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESACODE, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, BUSINESS, OR USE, ARISING FROM THE SERVICE. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
20. Indemnification
To the extent permitted by law, you agree to be responsible for claims and losses arising from your unlawful use of the service, violation of these Terms, or fabrication/use of a design in a manner for which you are responsible.
21. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws principles, except where applicable consumer law requires otherwise.
22. Changes to this document
We may update these Terms and Privacy Policy. The effective date will be updated when changes are published. For material changes, ESA Motion may require you to review and accept a new version before accessing a product again.
